The general approaches used in most communities is to only allow dry cleaners and other polluting uses in commercial or industrial districts. Sometimes conditional use permits or special exceptions are required in these districts, but especially in neighborhood commercial or mixed use districts. This approach allows for a flexible approach to regulation, based on the specific site and operating conditions. In addition to local efforts, several states have regulations related to dry cleaners and other polluting uses. Below we provide a few examples of local air quality ordinances for dry cleaners and auto body and painting establishments.
Dry cleaning
Rapho Township , Lancaster County , PA Zoning Ordinance
Dry cleaners are permitted in neighborhood commercial district subject to special exception, criteria are specified to minimize impacts on adjacent residential uses
EPA Model Ordinance, Groundwater Protection Overlay
Specifies certain uses that are not allowed in areas which could impact public water supplies.
Howard County , IN Wellhead Protection Overlay District and Flood Hazard Overlay District
Dry cleaners are prohibited in these districts in order to minimize groundwater impacts (see page 3-10, 3-12)
California Air Resources Board – Air Quality and Land Use Handbook: A Community Health Perspective
Recommends 300-500 feet buffer between dry cleaners using perchloroethylene and sensitive land uses (e.g. residential) (see pages 27-31)
Auto body and painting:
Hoschton, GA Motor Vehicle Service and Repair Overlay District
The intent of the district is to cluster motor vehicle retail and service facilities. The regulation requires that services be conducted in enclosed buildings. Permitted uses in the overlay district include motor vehicle body and paint facilities, among other uses.
Los Angeles , CA Interim Automotive Uses Ordinance
Requires a conditional use permit and prevents automotive uses from being located in pedestrian oriented, commercial and art craft community design overlay, historic preservation overlay, or transit oriented district. Requires that spray painting be conducted in fully enclosed structure and 500 feet from a residential zone.
